These Terms of Service govern your use of PortfolioVault and its services. By accessing and using our website, you agree to comply with these terms and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services. We reserve the right to modify these terms at any time, and your continued use of our platform constitutes acceptance of any changes. These terms apply to all users, including freelance web designers in Canada and beyond who use our training and portfolio-building resources.
Acceptance of Terms
By creating an account or accessing our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. We provide training resources, portfolio guidance, and educational materials to help freelance web designers build professional portfolios. Your use of our services indicates your acceptance of these terms in their entirety. We reserve the right to refuse service to anyone who violates these terms or engages in harmful, abusive, or illegal conduct. If you are under 18 years of age, you must have parental or guardian consent to use our services. We are not responsible for any unauthorized use of your account.
User Obligations
You agree to use our platform only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must not engage in any conduct that could harm, disable, or impair our services, including attempting to gain unauthorized access, disrupting service availability, or introducing malware. You agree not to upload, transmit, or distribute any content that is illegal, defamatory, obscene, or violates intellectual property rights. We monitor activity on our platform and reserve the right to suspend or terminate accounts that violate these obligations without notice.
Intellectual Property Rights
All content on our platform, including course materials, templates, guides, and educational resources, is the exclusive property of our organization or our content providers. You are granted a limited, non-exclusive license to access and use this content for personal, non-commercial educational purposes only. You may not reproduce, distribute, modify, or create derivative works from our materials without explicit written permission. Any portfolio work you create using our platform and your own original designs remains your intellectual property. However, we retain the right to display anonymized versions of student work as case studies or examples, unless you opt out. You must respect copyright and intellectual property laws in all jurisdictions where you operate.
Limitation of Liability
Our services are provided on an “as-is” basis without warranties of any kind. We are not liable for any indirect, incidental, consequential, or punitive damages resulting from your use of or inability to use our platform, including loss of income, data, or business opportunities. Our total liability to you shall not exceed the amount you paid for our services in the past twelve months. We do not guarantee that our platform will be uninterrupted, error-free, or completely secure. While we implement industry-standard security measures, we cannot guarantee the protection of your data against all threats. You assume all risks associated with your use of our services and acknowledge that we are not responsible for third-party actions or content.
Termination of Service
We reserve the right to suspend or terminate your account immediately if you violate these Terms of Service or engage in any prohibited conduct. Upon termination, your access to our platform will be revoked, and you may lose access to your account data. You may request account deletion at any time, subject to applicable data retention laws. We may also discontinue our services or modify features without prior notice. Termination does not relieve you of any outstanding obligations or liabilities. Any provisions of these terms that by their nature should survive termination, including intellectual property rights and limitation of liability, shall remain in effect after termination of your account or our services.
